This website is owned and operated by Freebrights Limited T/A Huffkins, a company registered in England under number 03690946 with its registered office at 98 High Street, Burford, Gloucestershire, OX18 4QF. Throughout the site, the terms “we”, “us” and “our” refer to Huffkins.
Huffkins offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.
Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.
Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

SECTION 1 - ONLINE STORE TERMS
- By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.
- You may not use our products for any illegal or unauthorised purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
- You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your Services.
SECTION 2 - GENERAL CONDITIONS
- We reserve the right to refuse service to anyone for any reason at any time.
- We reserve the right to specify the method or methods of payment we will accept for our products and services for any reason at any time. For the avoidance of doubt, this includes the right to refuse cash payment and specify payment by card only.
- You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
- You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.
- The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
SECTION 3 - APP TERMS & CONDITIONS
1. App Terms
1.1 These terms and conditions (the "Terms") govern any and all use of any mobile application we release from time to time (the "App"). These terms apply to any user of our App ("you", "your").
1.2 When we refer to the App we include all associated products and services together in these Terms.
1.3 You should be aware that, although these Terms apply to everyone who uses our App, there are other terms and conditions, policies and notices which might also apply in addition to these Terms.
1.4 You should be aware that, if you access our App, other terms and conditions (like those of the Apple Store or Google Play Store, or your device's manufacturer) may also apply. it is your responsibility to comply with those.

2. Acceptance of Terms
2.1 Your access to, and use of, the App is subject to these Terms and, if applicable, the other terms.
2.2 You must not use the App for any purpose that is unlawful or prohibited by these Terms or any applicable other terms.
2.3 By using the App you are fully accepting the terms, conditions and disclaimers contained in these Terms. If you do not accept these Terms you must immediately stop using the App.
3. Advice and Information
3.1 The contents of the App do not constitute advice and should not be relied upon in making or refraining from making, any decision.
3.2 We try to ensure that the information on our App is accurate and complete but we cannot guarantee this.
3.3 If you have any questions about allergies or intolerances, please do ask in store.
4. Changes to the App and Terms
Huffkins reserves the right to:
4.1 change or remove (temporarily or permanently) the App or any part of it without notice, and you agree that Huffkins shall not be liable to you for any such change or removal; and
4.2 change these Terms at any time, and your continued use of the App following any changes shall be deemed to be your acceptance of such change.
5. Links to Third Party Websites
5.1 The App may include links to third party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and you acknowledge and agree that we are not responsible for the content or availability of any such sites.
6. Intellectual Property Rights
6.1 All copyright, trademarks and all other intellectual property rights in and to the Website, the App and their content (including without limitation all design, text, graphics and all software and source codes connected with the App) are owned by or licensed to Huffkins or otherwise used by Huffkins as permitted by law.
6.2 In accessing the App you agree that you will access the content solely for your personal, non-commercial use. None of the content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without our prior written consent.
7. Personal Data
7.1 We will only use your personal information as set out in our Privacy Policy.
8. Disclaimers and Limitation Of Liability
8.1 The App is provided on an "AS IS" and "AS AVAILABLE" basis without any representation or endorsement made and without warranty of any kind whether express or implied. Without prejudice to the generality of the foregoing, we do not warrant or represent that the App will be of satisfactory quality, fit for a particular purpose, non-infringing, compatible with any other software or hardware, secure or accurate.
8.2 To the extent permitted by law, Huffkins will not be liable for any indirect or consequential loss or damage whatsoever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the App.
8.3 Huffkins makes no warranty that the functionality of the App will be available, uninterrupted or error free, that defects will be corrected or that the App or the servers that make it available are free of viruses or other harmful code.
8.4 Nothing in these Terms or the other terms shall be construed so as to exclude or limit the liability of Huffkins for death or personal injury as a result of the negligence of Huffkins or that of its employees or agents, and shall not limit or exclude any of your statutory rights as a consumer.
8.5 You agree that some features and functionality of our App may also be dependent on your device, internet connection, browser, settings and permissions. For example, if you don't allow us to use cookies or similar technologies, then you might not be able to use certain features and functionality that rely on those technologies; and if you don't allow our website/app to use your location, we won't be able to deliver location-based services.
9. Indemnity
9.1 You agree to indemnify and hold Huffkins and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against Huffkins or its subsidiary sites arising out of any breach by you of these Terms or the applicable other terms, or other liabilities caused directly or indirectly by your use of the App.
10. Severance
10.1If any of these Terms should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term shall be severed and the remaining Terms shall survive and remain in full force and effect and continue to be binding and enforceable.
SECTION 4 - HUFFKINS COFFEE CLUB MEMBERSHIP
1. Huffkins Coffee Club Membership terms and conditions
1.1. These are the terms and conditions (the “Huffkins Coffee Club Terms”) on which we supply Membership services and products including our "Huffkins Coffee Club Membership". These terms and conditions, and the Huffkins App Account & Loyalty terms and conditions, are mandatory for anyone purchasing a Huffkins Coffee Club Membership - if you do not confirm your acceptance of these terms and conditions during the order process, you will not be able to order a Huffkins Coffee Club Membership. In order to manage your Huffkins Coffee Club Membership, you must sign up for a Huffkins App Account.
2. Ordering Our Huffkins Coffee Club Membership
2.1. We can only accept Huffkins Coffee Club Membership orders from those aged 18 or over and who have legal capacity to enter into a binding contract with us. You must be located in the UK, and cannot be in breach of any agreements with us or any of our terms and conditions (including these ones).
2.2. Our Huffkins Coffee Club Membership is only available in Participating Shops in the UK and cannot be redeemed in the Excluded Shops (each as defined in clause 3.5 below).
2.3. In order to submit an order, you will be required to provide your details and then follow the procedure set out on the Huffkins App to submit your order. You will be required to sign up for a Huffkins App Account, and will therefore need to agree to the terms and conditions applicable to Huffkins App Accounts, available at the below section ‘Huffkins App Account & Loyalty’. You should check all of the information that you enter and correct any errors before submitting your order, as once your order is submitted we will begin processing it immediately. We may verify your payment, personal and location details, more information on this can be found in our Privacy Policy. All orders placed and processed via the Huffkins App shall be in the English language. These terms and conditions are only available in the English language and will not be filed by us.
2.4. Your order constitutes an offer to us to buy a Huffkins Coffee Club Membership. Our acceptance of that offer (and the formation of a contract between you and us according to these terms and conditions) will take place when we send you a confirmation email to accept your Huffkins Coffee Club Membership order, at which point a legally binding contract will be formed between you and us pursuant to these terms and conditions.
2.5. Our Excluded Shops include any temporary Huffkins ‘pop-up’ shop in the UK or overseas. All other UK Huffkins shops are “Participating Shops”. We may add Huffkins sites to the list of Excluded Shops from time to time and this will be available for you to review on our website. We do not guarantee that any new Huffkins locations that we set up from time to time will be Participating Shops.
2.6. If we are unable to accept your order, we will inform you of this by email and will not charge you for the Membership. This might be:
2.6.1. because Huffkins Coffee Club Memberships are no longer available;
2.6.2. because of unexpected limits on our resources which we could not reasonably plan for;
2.6.3. because you do not have a Huffkins App Account; and/or
2.6.4. because we have identified an error in the price or description of the Huffkins Coffee Club Membership options.
3. Other terms and conditions
3.1. These terms and conditions only govern the Huffkins Coffee Club Membership, so they apply in addition to any other agreements made between you and us, and any policies and notices that we communicate to you from time to time (each to the extent applicable).
4. Your Huffkins Coffee Club Membership
4.1. By ordering the Huffkins Coffee Club Membership and paying the recurring monthly or annual Membership fees (as set out in your order) to keep your Huffkins Coffee Club Membership active, you will be able to redeem your Huffkins Coffee Club Membership in any of the Participating Shops to get: (i) the number of hot drinks you are entitled to every day depending on your membership tier and (ii) the Huffkins Coffee Club Discount (each subject to our opening hours, which may vary by location and from time to time and subject to availability of Eligible Products) for each period of a valid Huffkins Coffee Club Membership. We reserve the right to change the number of eligible Drinks per day in our membership tiers and the products included in the Huffkins Coffee Club Discount from time to time, subject always to providing you with forty (40) days’ notice in accordance with clause 9.
4.2 Once we have accepted your Huffkins Coffee Club Membership order and for each month, or each year for annual coffee club membership, that your Huffkins Coffee Club Membership is successfully renewed, you will receive an email confirming that your payment has been successful. Your Huffkins Coffee Club Membership starts on the day we send your confirmation of membership activation email. It is your responsibility to check your email, including, if necessary, your spam folder. Once you have received your confirmation of membership activation email, you can use your Huffkins Coffee Club Membership straight away by logging into your Huffkins App Account and accessing the QR code on your Huffkins App. In order to redeem your Huffkins Coffee Club Membership against an eligible Product (as defined in clause 6.1.1 below), you will need to present your QR code at a scanner in our shops by using the Huffkins App. The QR code can only be used in Participating Shops and cannot be redeemed online. Your QR code may be refreshed from time to time. We cannot accept paper copies or screenshots of your QR code and we cannot provide any eligible Products without a valid QR code. If you have a disability or otherwise have difficulty accessing or navigating our Huffkins App, please contact us at victoria@huffkins.com.
4.3. You should keep your QR code confidential, and you are not permitted to share it with any other person. It is your responsibility to ensure that nobody obtains unauthorised use of your QR code, and we won't be held liable for any loss suffered by you (including any lost Membership perks) for any such unauthorised use of your QR code, unless it is due to our fault or negligence. We are not obliged to issue a new QR code to you in the event you do not keep your QR code confidential. If we reasonably suspect that you are sharing your QR code in breach of these terms and conditions, we may suspend your account while we investigate. Investigations may take up to fourteen (14) days. If we find that you have breached these terms and conditions in a serious way, we may cancel your Huffkins Coffee Club Membership with immediate effect and without refunding you for the remaining period of your Huffkins Coffee Club Membership. We also reserve the right to ban your Huffkins App Account and take further action if we deem it appropriate.
4.4. Your Huffkins Coffee Club Membership will renew automatically each month for monthly membership tiers or annually for the annual membership tier and will continue unless cancelled by you or us in accordance with these terms and conditions. Each monthly membership period is one calendar month, starting when you first subscribe. For example, if your Huffkins Coffee Club Membership is accepted on 18th of June, it will be valid until 17th of July. The recurring monthly Membership fee would then be charged on 18th of July for the next Membership month which would run until 17th of August. Each annual membership period is for 365 days, the recurring fee would be charged 365 days after the first membership payment is taken.
4.5. You may redeem your Huffkins Coffee Club Membership for the eligible number of drinks per day you are entitled to depending on your membership tier, if you are entitled to more than 1 drink you can redeem your entitlement at the same time or at different times across the day. This applies to orders placed at the till, both to sit in or take away, and is subject to availability of eligible Drinks and our opening hours.
4.6. We only supply Huffkins Coffee Club Memberships for private and non-commercial use. We reserve the right at any time and in our sole discretion to verify a subscriber’s eligibility and compliance with these terms and conditions, including but not limited to, ensuring that the Huffkins Coffee Club Membership is not being used for a commercial purpose.
4.7. There is a limit of one Huffkins Coffee Club Membership per person. You must not register for a new Huffkins Coffee Club Membership account with new details (a "Duplicate Membership"), even where an older Huffkins Coffee Club Membership has expired, unless you have a bona fide reason to do so (for example, because you have lost access to the original email account used when you signed up). We reserve the right to carry out checks for Duplicate Memberships and to terminate any Duplicate Memberships that we become aware of. If we cancel a Duplicate Membership you will lose any campaign offer or Voucher which you had been granted in error as a result of signing up for a Duplicate Membership. If you reactivate that Duplicate Membership in your account (to the extent we allow you to), you will therefore be charged the current Membership price.
4.8. Where you have requested that your personal details are deleted, including a previous Huffkins Coffee Club Membership, and you subsequently re-register for a new Huffkins Coffee Club Membership, this shall be considered a Duplicate Membership. In accordance with our Privacy Policy, we reserve the right to retain your details for fraud prevention purposes.
4.9. Any Eligible Products redeemed using your Huffkins Coffee Club Membership must be for personal consumption only, and not for resale.
4.10. Huffkins Coffee Club Memberships cannot be exchanged for other goods or products and are only eligible for refunds to the extent expressly set out in these terms and conditions.
5. Huffkins Coffee Club Membership Products
Eligible Drinks
5.1. You will be able to redeem your Huffkins Coffee Club Membership against all barista-made hot drinks including coffees, teas, tisanes, chais and hot chocolates ("Eligible Drinks") with free syrups, whipped cream, alternative milks and shots.
Cold drinks are not included.
5.2. All Eligible Drinks are subject to availability, equipment, and staffing resources, and all of our usual terms and conditions, in addition to any particular terms, conditions, rules or policies which may apply in any particular Participating Shop. The list of Eligible Drinks may change from time to time and we will endeavour to update this list as and when products are added or removed and notify you at least forty (40) days before any significant changes to the list.
5.3. We may decide from time to time, at our sole discretion, that Eligible Drinks may not be redeemed in reusable cups due to health and safety implications.
Huffkins Coffee Club Discount
5.4. Your Huffkins Coffee Club Membership will also entitle you to 15% off all Huffkins products in Participating Shops (together with the Eligible Drinks, the “Eligible Products”) (“Huffkins Coffee Club Discount”) subject to the following terms:
5.4.1. The Huffkins Coffee Club Discount is available seven days a week during the opening hours of the relevant Participating Shop (which may vary by location and from time to time). The level of discount you are entitled to will be shown in your app.
5.4.2. There is no limit on frequency of use or the total amount of discount that can be claimed in each Membership period.
5.4.3. The Huffkins Coffee Club Discount cannot be used in conjunction with other Vouchers, discounts or discount codes, including bundles, campaigns or other promotions offered by Huffkins from time to time.
5.4.4. For purchases made in Participating Shops which sell gift cards, the Huffkins Coffee Club Discount does not apply to gift cards or vouchers.
5.4.5. Gift cards are not eligible for Huffkins Coffee Club Discount.
5.4.6. The Huffkins Coffee Club Discount is subject to availability of Huffkins products, and all of our usual terms and conditions, in addition to any particular terms, conditions, rules or policies which may apply in any particular Participating Shop. The products included in the Huffkins Coffee Club Discount may change from time to time and we will endeavour to update these terms and conditions as and when products are added or removed and notify you at least forty (40) days before any significant changes to the list.
5.5. If you have any questions on our ingredients or produce, please do ask in store.
6. Membership Fees
6.1. Membership fees. Subject to any cancellation of your Huffkins Coffee Club Membership, we will charge you the monthly or annual Membership fees using the payment method selected by you during the order process (or any updated details provided by your bank in the event that you receive a new card). We reserve the right to change the Membership fee upon providing at least forty (40) days’ notice to you, subject always to your ability to cancel your Huffkins Coffee Club Membership in accordance with the relevant terms. The Membership fee includes VAT. Your first payment will be taken the day you sign up for the Huffkins Coffee Club Membership.. You accept that the Huffkins Coffee Club Membership will automatically renew and has automatically recurring payments as detailed in these terms and conditions, and that you will be responsible for all recurring fees. Your Huffkins Coffee Club Membership provides you the right to use Membership benefits at your discretion (subject to these terms and conditions). Your non-use will not obligate us to provide you with any refund, in whole or part, of your Membership fee. You remain responsible for any uncollected amounts. Should you wish to take part in any of our additional services, additional charges may be levied if applicable. If a payment is not successfully settled, due to payment method expiration, insufficient funds, the chargeback of a previously valid payment, or otherwise, and you do not cancel your Membership, we may suspend your access to the Membership until we are in receipt of cleared funds from you for the Membership and subsequently cancel it if payment is still not received.
6.2. Discount or promotional codes. We may offer discounts, promotions and other types of voucher codes (“Voucher(s)”) from time to time.
6.3. Vouchers may only be used once by you and are not transferable or redeemable for cash. Vouchers may not be copied, reproduced, distributed, shared with or used by others or published either directly or indirectly in any form or stored in a data retrieval system without our prior written approval.
6.4. Vouchers may only be redeemed via the Huffkins App and not through any other website or method of communication.
6.5. Unless otherwise stated, Vouchers cannot be used retrospectively, are only redeemable once per customer, and cannot be used in conjunction with other Vouchers, discount codes or offers. For the avoidance of doubt, in the event that you seek to redeem an additional Voucher where an existing Voucher has already been applied, the existing Voucher will automatically be removed and the additional Voucher will be applied instead.
6.6. We reserve the right to withdraw, deactivate or cancel any Voucher for any reason at any time, including excluding the use of Voucher codes for specific products or services that we may offer from time to time. Please note that certain Vouchers will be time-limited and subject to availability. We also reserve the right to reject any Voucher if we suspect breach of these terms and conditions or any fraud.
6.7. We may promote campaigns from time to time. Each campaign has its own terms which will be made clear at the time of issue. In the event of any conflict or inconsistency with any other terms and conditions for such campaigns, the specific terms of the campaign will prevail.
6.8. Campaign offers may be redeemed automatically through our website or the Huffkins App and not through any other website or method of communication.
6.9. We reserve the right to cancel, amend, withdraw, terminate or temporarily suspend any campaigns for any reason at any time.
6.10. Payment can be made by any eligible debit or credit card.
6.11. Subject to either you or us exercising our rights to cancel or terminate the Huffkins Coffee Club Membership, you authorise us to, and accept that we will, charge your original payment method on a recurring monthly basis for monthly tier memberships, beginning on the day after your first month of Membership ends and every month thereafter until you cancel or we suspend or terminate your access to the Huffkins Coffee Club Membership. The recurring Membership fees will be charged on the same day each month or where you start your Huffkins Coffee Club Membership on the last day of a month, your recurring payment will be taken on the last day of the following month. For example, if you subscribed on the 6th September, your next payment would be on the 6th October. If you subscribed on the last day of the month, and your billing date is not present in that month (say, the 31st), then the preceding date is selected. Then the renewal shifts back to the original date in the next month. For example if you subscribed on 31st March, your next payment will be on the last day of the following month, 30th April, and subsequently on 31st May, 30th June, etc.
For annual memberships subject to either you or us exercising our rights to cancel or terminate the Huffkins Coffee Club Membership, you authorise us to, and accept that we will, charge your original payment method on a recurring annual basis beginning on the day after your first 365 days of Membership ends and every 365 days thereafter until you cancel or we suspend or terminate your access to the Huffkins Coffee Club Membership.
6.12. For monthly memberships after the recurring monthly payment has been received, we will email you to confirm your Huffkins Coffee Club Membership has been renewed for another month. Unless you cancel your Huffkins Coffee Club Membership, it will be automatically renewed for successive months at the then-current Membership fee.
For an annual membership renewal after the annual payment has been taken we will email you to confirm your Huffkins Coffee Club Membership has been renewed for another year. Unless you cancel your Huffkins Coffee Club Membership, it will be automatically renewed for successive years at the then-current Membership fee
We reserve the right not to renew your Huffkins Coffee Club Membership at any time without cause. Payment details are stored securely by a third party to allow recurring payment for future recurring payments.
6.13. If payment of a recurring Membership fee fails because there is an issue with the payment method, for example, the debit card has expired, we will contact you via email. You may add, update or change payment cards or other Membership details such as email address and billing address can be updated and changed by logging in to your account management page through the App.
6.14. If the amount to be charged for a recurring Membership fee changes from the current fee, we shall provide notice of the amount to be charged and the date of the change of the fee at least forty (40) days before the scheduled date of payment of the recurring Membership fee. If, as a result of the fee change, you want to cancel your Membership, please follow the steps in clause 9.2 below.
7. Cancelling your Huffkins Coffee Club Membership
7.1. You can cancel your Huffkins Coffee Club Membership at any time.
For monthly Memberships, the cancellation will be effective from the end of the Membership month in which you cancel.
For annual Memberships, the cancellation will be effective from the end of the year (365 day period) you signed up for.
Other than as set out in clause 9.5, cancellations are not eligible for refunds.
7.2. To cancel your Huffkins Coffee Club Membership you need to click the ‘manage account’ link provided in any of your Membership renewal emails. Once you login, you will then be able to view your Huffkins Coffee Club Membership and cancel it. If you have any difficulties in cancelling your Huffkins Coffee Club Membership, please get in touch with us via our Get in Touch page.
7.3. Cancellation for monthly memberships will take effect at the end of the Membership month in which you cancel it so you can continue to use your existing Membership until your Membership month has expired. The recurring Membership fee will not be taken from you the following Membership month. You will not receive a refund for any part of a month in which you cancel.
For example, if you start your paid Membership on 7th September, cancel it on the 19th September, you can continue to use it until 6th October at which point it will expire.
If you cancel an annual membership you can continue to use your existing Membership until your Membership year has expired. The recurring annual Membership fee will not be taken from you at the end of the 365 day period which you signed up for. You are not entitled to receive a refund for the remainder of the year if you cancel your annual membership partway through a Membership year.
7.4 Clauses 7.5-7.9.2.2 relate to your rights to cancel your Huffkins Coffee Club Membership and receive a refund (where relevant) if you are acting for purposes that are wholly or mainly outside of your trade, business, craft or profession (a "Consumer").
7.5. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (the "Regulations") you have the right to cancel your Huffkins Coffee Club Membership, for any reason, within 14 days of the date of your Membership starting (the “Cooling-off Period”). Please note that this right to cancel will not apply to any monthly renewals of Huffkins Membership for members in our monthly membership tiers or annual renewals of Huffkins Membership for members in our annual membership tier.
7.6. If you wish to exercise your right to cancel, you may do this by logging in to your account and selecting the option to cancel your Huffkins Coffee Club Membership.
7.7. We will send you an acknowledgement of receipt by email.
7.8. If you exercise your right of cancellation, this contract will come to an end and we will reimburse you any payments received from you for your Huffkins Coffee Club Membership. We will make this reimbursement no later than 14 days after the day on which we are informed about your decision to cancel your Huffkins Coffee Club Membership. We will make the reimbursement using the same means of payment you use to pay for your Huffkins Coffee Club Membership, unless you expressly agree otherwise.
7.9. You expressly acknowledge and agree that:
7.9.1. we may give you access to your Huffkins Coffee Club Membership during the Cooling-Off Period; and
7.9.2. if you exercise the right to cancel
7.9.2.1 prior to using your Huffkins Coffee Club Membership, you will receive a full refund (which may be £0);
7.9.2.2. after you have started using your Huffkins Coffee Club Membership, any refund will be reduced pro rata in accordance with the number of days your Huffkins Coffee Club Membership has been active.
8. Managing your account
8.1. When you have a Huffkins Coffee Club Membership, you will be able to login to your Huffkins App Account via the App. Once you have logged in, you are able to:
8.1.1. check your account information and Membership details;
8.1.2. update your address and payment details;
8.1.3. see your billing history and download past invoices; and
8.1.4. cancel your Huffkins Coffee Club Membership.
8.2. For more details, please see our Huffkins App Account & Loyalty Terms.
8.3. For the avoidance of doubt, where you have requested the deletion of your Huffkins App Account and associated Huffkins Coffee Club Membership and you decide to re-subscribe, you will not be eligible for any new subscriber promotions or Vouchers.
9. Our Rights to End the Contract
9.1. If you do not make any payment to us when it is due, we will write to you to remind you that payment is due. If you still do not make payment within 9 days of us reminding you that payment is due, we may end the contract by giving you written notice.
9.2 We may withdraw the Club Huffkins Membership. We will write to you to let you know that we are going to stop providing the Club Huffkins Membership. We will let you know at least 1 month in advance of our stopping the Huffkins Coffee Club Membership and will not take any subsequent recurring monthly Membership fees.
9.3 We may cancel your Huffkins Coffee Club Membership if:
9.3.1. you are in serious breach of these terms and conditions;
9.3.2. you are in serious breach of any other terms and conditions or agreements with us, and we reasonably believe that such breach may prejudice the performance of your obligations under these terms and conditions;
9.3.3. you breach these, or any other, terms and conditions in a way which is not serious but is: (i) repeated; or (ii) not put right within 30 days of us notifying you of the breach;
9.3.4. you engage in antisocial or unacceptable behaviour towards our employees or other customers in our shop.
10. If there is a Problem with the Huffkins Coffee Club Membership or the Ordering Process
10.1. If you have any questions or complaints about the Huffkins Coffee Club Membership, please contact us. You can reach us via the Get in Touch page at huffkins.com. Alternatively, please speak to one of our staff in one of our shops.
11. Responsibility for Loss or Damage Suffered by You
11.1. Nothing in these terms and conditions limits our liability which cannot legally be limited, including liability for death or personal injury caused by negligence; or fraud or fraudulent misrepresentation.
11.2. Subject to the other provisions of this clause, our liability to you under and in respect of these terms and conditions is limited at the cost of the Membership fees paid by you under these terms and conditions.
11.3. We are not liable for business losses. We only supply the Huffkins Coffee Club Membership for personal use. If you use the Huffkins Coffee Club Membership for any commercial, business or resale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
11.4. If we fail to comply with these terms and conditions, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these terms and conditions or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it was an obvious consequence of our breach or if it was contemplated by you and us at the time that the contract between you and us for your order became binding (i.e. when the confirmation email for that order was issued).
12. How we may use your Personal Information
12.1. We are committed to protecting your privacy and maintaining the security of any personal information received from you. Any data you submit to us will be held by us in accordance with our Privacy Policy. Our Privacy Policy can be viewed at huffkins.com
13. Other Important Terms
13.1. We reserve the right to update, change, modify or terminate the Huffkins Coffee Club Membership and these terms and conditions:
13.1.1. immediately on notice to you if there is a change in applicable law or regulation or there are security reasons which mean that we need to change the Membership and/or these terms and conditions; or
13.1.2. effective from the beginning of your next renewal if we need to change the Huffkins Coffee Club Membership and/or these terms and conditions for any other reason. If you do not agree to any updates, changes or modifications you have the right to cancel this Contract by following the steps outlined above.
13.2. We reserve the right to refuse to accept a new Huffkins Coffee Club Membership order or any renewal if we reasonably believe that you are not complying (or have not in the past complied) with these terms and conditions.
13.3. Huffkins Coffee Club Membership may be used in conjunction with any other promotion run by us unless we specify otherwise.
13.4. If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms and conditions operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
13.5. Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms and conditions, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you but we continue to provide the Membership, we can still require you to make the payment at a later date.
13.6. We shall not be in breach of these terms and conditions nor liable for delay in performing, or failure to perform, any of our obligations under these terms and conditions if such delay or failure result from events, circumstances or causes beyond our reasonable control (including, without limitation, the outbreak or any re-occurrence of coronavirus (COVID-19) or similar diseases). In such circumstances, we shall be entitled to a reasonable extension of the time for performing such obligations and may:
13.6.1. suspend your Huffkins Coffee Club Membership for the period during which your Membership cannot be used (for example, because relevant Participating Shops need to be temporarily closed). During such a suspension period, we will take no further payments from you under these terms and conditions. In this case, the then current Membership period for your Membership will continue once your Membership can be used again or may be terminated in accordance with clause 16.6.2 below; and
13.6.2. if the period of delay or non-performance continues for a significant period of time, we may terminate your Membership. If we terminate under this clause 16.6.2, we cannot refund the the Membership fee prepaid by you for the current billing period, but your Membership will not renew on the beginning of the next billing period.
SECTION 5 - APP ACCOUNT & LOYALTY TERMS
1 App Account & Loyalty Terms
1.1 These terms and conditions (let's call them the "Huffkins App Account & Loyalty Terms") govern basis on which you may register for and use any personal account sections and functionality of our website and/or any mobile app that we may release from time to time (a "Huffkins App Account"), and the Loyalty Scheme (“Huffkins Loyalty Scheme”) operated by us. More information about what your Huffkins App Account is, and the functionality that it offers, is set out in section 4 below, and further information about what we mean by Huffkins Loyalty Scheme, our Loyalty Scheme, is set out in section 9 below.
1.2 These Huffkins App Account & Loyalty Terms apply to any person who signs up for, or seeks to sign up for, a Huffkins App Account and/or who participates, or seeks to participate, in Huffkins Loyalty Scheme (that's who we mean by "you" or "your") or has a Huffkins Coffee Club Membership.
1.3 Among other things, these Huffkins App Account & Loyalty Terms provide important information about:
1.3.1 what the Huffkins App Account is, its functionality, and how to use it;
1.3.2 any requirements for signing up for a Huffkins App Account, and any limitations or restrictions that might apply to your use of the Huffkins App Account; and
1.3.3 other important information about your and our rights and obligations in relation to the use and administration of your Huffkins App Account;
1.3.4 what Huffkins Loyalty Scheme (the Loyalty Scheme) is, how it works, and how to participate;
1.3.5 any requirements for participating and limitations on who can participate in Huffkins Loyalty Scheme;
1.3.6 what purchases are 'eligible' to count towards Huffkins Loyalty Scheme; and
1.3.7 other important information about your and our rights and obligations in relation to Huffkins Loyalty Scheme, our Loyalty Scheme.
1.4 Please ensure that you read these Huffkins App Account & Loyalty Terms carefully, and that you have understood them, before agreeing to them. Once you agree to these Huffkins App Account & Loyalty Terms, they will be legally binding on you.

1.6 Please note that we may revise these Huffkins App Account & Loyalty Terms at any time by amending them on our website/app. Please check for the most current version of these Account Terms at huffkins.com each time you use our services.
2 Other terms and conditions
These Huffkins App Account & Loyalty Terms only govern the Huffkins App Account and Huffkins Loyalty Scheme, our Loyalty Scheme, so they apply in addition to any other agreements made between you and us, and any policies and notices that we communicate to you from time to time (each to the extent applicable).
3 The Huffkins App Account is a central hub for you to manage your relationship with us and to make it easier for you to request, and for us to deliver, our products and services including the Huffkins Coffee Club Membership and Huffkins Loyalty Scheme. The functionality associated with the Huffkins App Account includes the following:
3.1 basic account administration;
3.1.1 create an account;
3.1.2 sign in to, and log out of, our app;
3.1.3 reset your password; and
3.1.4 edit your basic personal details in accordance with these Huffkins App Account & Loyalty Terms.
3.2 Huffkins Loyalty Scheme (the Loyalty Scheme)
3.2.1 participate in Huffkins Loyalty Scheme;
3.2.2 view your QR codes to participate in Huffkins Loyalty Scheme (and Coffee Club Membership as appropriate);
3.2.3 earn Stamps for Qualifying Purchases, receive and redeem Huffkins Loyalty Scheme Rewards;
3.2.4 receive personalised offers linked to Huffkins Loyalty Scheme,
all subject to and in accordance with these Huffkins App Account & Loyalty Terms.
3.3 Manage your Huffkins Coffee Club Membership
3.3.1 sign up for a Huffkins Coffee Club Membership service;
3.3.2 manage, cancel or pause your subscription;
3.3.3 view your QR code for your Huffkins Coffee Club Membership; and
3.3.4 view your subscription billing history and amend your subscription payment details, all subject to and in accordance with our Huffkins Coffee Club Membership Terms.
3.4 We try to make our Huffkins App Account as useful and user friendly as possible, and that means that we will from time to time add and remove features and functionality to reflect our customer feedback, any changes in law or regulation, changes in our business model, and best practice. For that reason, the Huffkins App Account functionality set out in these Huffkins App Account & Loyalty Terms is only illustrative – we may make changes to the Huffkins App Account features and functionality without notice, and we cannot guarantee that any particular functionality will be available at any given time. For more information, see section 8 below.
3.5 Some features and functionality may also be dependent on your device, internet connection, browser, settings and permissions. For example, if you don't allow us to use cookies or similar technologies, then you might not be able to use certain features and functionality that rely on those technologies; and if you don't allow our website/app to use your location, we won't be able to deliver location-based services.
3.6 If you have any questions on allergens, intolerances, ingredients or produce, please do ask in store.
4 Registering for a Huffkins App Account
4.1 You are eligible for a Huffkins App Account if you:
4.1.1 complete the sign-up process correctly;
4.1.2 agree to these Huffkins App Account & Loyalty Terms and any other of our terms and conditions which might be relevant, and aren't in breach of any of those agreements/terms and conditions;
4.1.3 are 18+ and able to enter into binding contracts; and
4.1.4 are located in the UK.
4.2 Unfortunately, if you don't meet any of those eligibility criteria then you won't be eligible for a Huffkins App Account.
4.3 Only one Huffkins App Account is permitted per person. If you get locked out of your Huffkins App Account, or have any other issues, please let us know before trying to sign up for a new Huffkins App Account.
5 Your obligations and our right to withdraw the Huffkins App Account
5.1 By registering for, keeping and using a Huffkins App Account, you agree:
5.1.1 to only use your Huffkins App Account in a fair, reasonable and lawful way and in accordance with all applicable laws, regulations, terms and conditions, policies and notices;
5.1.2 to provide accurate, truthful, current and (where mandatory) complete information when creating your Huffkins App Account and to keep your account details up to date; and
5.1.3 to keep your Huffkins App Account secure, not share it with any other person, and do your best to prevent unauthorised access (i.e. by choosing a strong password and keeping your login details confidential). You'll be responsible for all activity on your account – even if its unauthorised – unless there's a security breach which is our fault. If you suspect any unauthorised access to your Huffkins App Account, please contact us right away so we can help you.
5.2 If we know, or reasonably suspect, that you are using your Huffkins App Account in a fraudulent, improper, unfair or unlawful way or that you are otherwise in breach of these Account Terms or any other applicable terms, we reserve the right (without limiting any other right we may have) to:
5.2.1 suspend or cancel your Huffkins App Account (including any subscription-related benefits under the Huffkins Coffee Club Membership Terms);
5.2.2 withdraw any Stamps or Rewards on your Huffkins App Account associated with Huffkins Loyalty Scheme; and
5.2.3 hold you liable for any and all damages, losses and liabilities that we suffer or incur as a result, and to pursue legal action and to notify your internet service provider.
5.3 If we suspend or cancel your Huffkins App Account, you may not re-register or join using the same or new details unless we formally invite you to.
5.4 We may also cancel your account in accordance with section 7 below.
6 Deleting and forfeiting your Huffkins App Account
6.1 You can request that we delete your Huffkins App Account by contacting our customer services at victoria@huffkins.com.
6.2 Please note that if you do decide to delete your Huffkins App Account, you won't be able to reactivate or restore it at a later date, and you will permanently lose access to your Huffkins App Account. This also means that you'll have waived and forfeit any accrued benefits linked to your Huffkins App Account (like credit and Huffkins Loyalty Scheme Stamps and Rewards) and you will be unable to purchase a Huffkins Coffee Club Membership. If you have an existing Huffkins Coffee Club Membership, your subscription will be cancelled.
6.3 We may also delete Huffkins App Accounts that are inactive for 24 months or more. If you don't use your Huffkins App Account for any 24 month period, you will have waived and forfeit your Huffkins App Account together with any accrued benefits linked to your Huffkins App Account (like credit and Huffkins Loyalty Scheme loyalty Stamps & Rewards).
6.4 When we cancel or delete your account, we will delete all associated personal data except for data that we are entitled or required to retain by law. For more information, see our privacy policy.
7 Our liability as regards your Huffkins App Account
7.1 Nothing in these Huffkins App Account & Loyalty Terms limits our liability or your rights in circumstances where it would be unlawful to do so. Nothing in these Huffkins App Account & Loyalty Terms limits your statutory rights as a consumer.
7.2 Our website and app, including the Huffkins App Account functionality, is provided "as-is", without any warranty or promise that it will meet a particular standard, be fit for a particular purpose, be uninterrupted or error free, or be available at any given time. Use of the Huffkins App Account is optional, and you must make your own decision regarding whether or not to use it according to these Huffkins App Account & Loyalty Terms.
7.3 We try to ensure that the information on our website and app is accurate and complete but we cannot guarantee this.
7.4 Certain of the services offered through your Huffkins App Account will be subject to local and offline conditions – for example, if you try to place an order through your Huffkins App Account, that will be subject to operating times and stock availability at the relevant Huffkins store.
7.5 Our liability to you in respect of these Huffkins App Account & Loyalty Terms and your Huffkins App Account is limited as set out in our general website terms and conditions.
8 The Huffkins Loyalty Scheme
Huffkins Loyalty Scheme, or the "Loyalty Scheme", is a loyalty rewards programme that we operate. Under the Loyalty Scheme:
8.1.1 each Qualifying Purchase (see section 11) entitles you to a digital token (which we call a "Stamp");
8.1.2 Stamps are applied to your Huffkins App Account; and
8.1.3 once you have collected 5 Stamps, you will (subject to these Huffkins App Account & Loyalty Terms) be eligible to claim a free product or other such reward, to be decided by us (each a "Reward"). We reserve the right to change the Loyalty Scheme programme at our discretion and without notice to you.
9 How to participate
9.1 You are eligible to participate in Huffkins Loyalty Scheme if you:
9.1.1 have a valid Huffkins App Account;
9.1.2 aren't in breach of any agreements with us or any of our terms and conditions (including these Huffkins App Account & Loyalty Terms);
9.1.3 you are 18+ and able to enter into binding contracts; and
9.1.4 you are located in the UK.
9.2 Unfortunately, if you don't meet any of those eligibility criteria then you won't be eligible to participate in Huffkins Loyalty Scheme, collect Stamps or earn Rewards.
9.3 You must be able to use our app in order to be able to fully participate in Huffkins Loyalty Scheme. That means you'll need a compatible device and suitable internet connection, for example. You should refer to our general terms of use for more details.
9.4 All Huffkins App Account holders are automatically provided with access to Huffkins Loyalty Scheme, however you are not (nor will you at any time be) obliged to participate in Huffkins Loyalty Scheme. If you do not wish to be enrolled in Huffkins Loyalty Scheme, you can delete your Huffkins App Account.
9.5 Any Qualifying Purchase where you scan your QR code in your Huffkins App Account (as long as you're logged in) will automatically earn you a Stamp. If you make a Qualifying Purchase in store, it is your responsibility to present and scan your QR code (available in the 'Wallet' section of the Huffkins app) at the point of sale to have the Stamp applied to your Huffkins App Account. We cannot accept paper copies or screenshots of your QR code. Your QR code may be refreshed from time to time.
9.6 If you don't present and scan your QR code then your Stamp won't be counted and there will be no way to have it subsequently applied to your Huffkins App Account.
10 Qualifying Purchases and Stamps
10.1 A Stamp will only be awarded for a Qualifying Purchase. A "Qualifying Purchase" is a purchase at a Huffkins store which:
10.1.1 requires the actual expenditure of money or gift card credit. For example, if a customer redeems a free drink as part of their Huffkins subscription, that would not in itself be a Qualifying Purchase. Likewise, redemption of a Reward will not in itself be a Qualifying Purchase;
10.1.2 is not part of a series of connected purchases. For example, if you purchase a number of items as separate transactions without a reasonable time period having passed between them (being a minimum of 60 minutes), we reserve the right to treat that as one set of connected purchases for which a maximum of 1 Stamp will be awarded;
10.1.3 is made at a participating Huffkins branch. Note that this excludes any orders made through third parties (like Deliveroo, UberEats and Just Eat). If you are in any doubt as to whether a particular Huffkins location participates in Huffkins Loyalty Scheme, please ask our staff before you make your purchase; and
10.1.4 is not subsequently returned, refunded or otherwise the subject of a credit or debit card 'chargeback'. Where a Stamp is awarded and such circumstances later come to light, we reserve the right to remove that Stamp from your Huffkins App Account.
11.2 If you have a Huffkins Coffee Club Membership, you can still collect and redeem Loyalty Stamps in the normal fashion.
10.3 We might, at our discretion and at any time, award you Stamps for any other reason, or for no reason at all - just to say thank you for being a loyal Huffkins customer.
10.4 We'll also regularly send you customised ‘family rewards’, which are special offers and discounts just for you. These appear in your Wallet section within the App and can be redeemed by scanning the QR code for that reward.
11 Stamps & Rewards
11.1 Stamps and Rewards are issued free of charge, have no cash value and cannot be redeemed (other than for a Reward in accordance with these Huffkins App Account & Loyalty Terms). They cannot be refunded.
11.2 Stamps and Rewards are personal to you and your Huffkins App Account. They cannot be transferred, traded or shared with anyone else.
11.3 When you have collected 5 Stamps, you will earn a Reward. Please note:
11.3.1 once the Reward has appeared in your Wallet, you can redeem your Reward in-store by scanning your QR code at checkout. If your purchase includes the Reward, the price of the Reward will be automatically deducted from your bill; or
11.3.2 you cannot collect Stamps or redeem your rewards when you order online to your table, for delivery via a 3rd party delivery partner, or as part of an online shopping order at huffkins.com.
11.4 If there is more than one eligible product in your (physical or digital) basket when you redeem your Reward, the most expensive item will be the one treated as the Reward and deducted from your bill (if and as applicable).
11.5 Rewards change from time to time and at our complete discretion. We cannot guarantee that you will be eligible for a particular Reward, that Rewards will be available at your time of redemption, or that Rewards will be of a minimum value. We will, however, try to give you a range of Rewards to choose from which may include items from our menu.
11.6 If you have any dietary requirements or allergies, please consult our allergen guide in the usual way before redeeming and enjoying any Rewards. We cannot guarantee any of our products will be suitable for those with allergies due to a high risk of cross contamination. Our vegan products are made to a vegan recipe but are not suitable for those with dairy and egg allergies. If you have any questions on our ingredients or produce, please do ask in store. In the event that any of your dietary requirements or allergies cannot be accommodated within the eligible Rewards offered, please speak to a member of staff who will do their best to accommodate your requirements. We cannot guarantee that a substitute Reward will be available in such circumstances.
11.7 Rewards can only be redeemed once. Once a Reward is earned this will extinguish your Stamps and to earn another Reward you will have to collect 5 new Stamps.
11.8 Once earned, Rewards will remain active for 30 days. You must redeem the Reward at that time. If you don't, it will expire and you won't be able to reclaim either the Reward or the Stamps.
11.9 Stamps will only remain eligible for Rewards while your Huffkins App Account remains active. To remain active, you must have completed a Qualifying Purchase within the last 12 months. Any Stamps that remain in your Huffkins App Account 12 months after your last Qualifying Purchase shall automatically expire.
11.10 We reserve the right to terminate and withdraw the Huffkins Loyalty Scheme Loyalty Scheme at any time for any or no reason. If we decide to do so, we will (where commercially viable) aim to give you at least 30 days' notice, at the end of which Huffkins Loyalty Scheme, and your Stamps, will disappear and be of no further value or use.
11.11 Rewards are not able to be redeemed as part of any other promotion, including any promotional deals that we may operate from time to time. Any eligible Rewards in your basket will be calculated before any other promotion is applied.
12 Your Obligations and our right to withdraw Huffkins Loyalty Scheme
12.1 You must only use Huffkins Loyalty Scheme in a fair, reasonable and lawful way and in accordance with all applicable laws, regulations, terms and conditions, policies and notices.
12.2 If we know, or reasonably suspect, that you are using Huffkins Loyalty Scheme in a fraudulent, improper, unfair or unlawful way, that you have or are attempting to abuse Huffkins Loyalty Scheme, or that you are in breach of these Huffkins App Account & Loyalty Terms or any other applicable terms, we reserve the right (without limiting any other right we may have) to:
12.2.1 suspend or cancel your Huffkins App Account;
12.2.2 withdraw any Stamps or Rewards on your Huffkins App Account; and
12.2.3 hold you liable for any and all damages, losses and liabilities that we suffer or incur as a result, to pursue legal action and to notify your internet service provider.
12.3 If we suspend or cancel your Huffkins App Account, you may not re-register or join using new details unless we formally invite you to.
13 General
13.1 If any of these Huffkins App Account & Loyalty Terms are found by any court or administrative body of competent jurisdiction to be illegal, invalid or unenforceable under the law of any jurisdiction, such illegality, invalidity or unenforceability shall not affect the legality, validity or enforceability in that jurisdiction of the other provisions of this agreement or the legality, validity or enforceability in any other jurisdiction of that provision.

13.3 Your Huffkins App Account, these Huffkins App Account & Loyalty Terms and any related dispute or claim (whether contractual or non-contractual) shall be governed by and construed in accordance with the laws of England and Wales and you agree to the jurisdiction of the Courts of England and Wales in relation to any such dispute or claim.
SECTION 6 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION
- We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.
- This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

- We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
- We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

- Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.
- We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.
- We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time.
